Terms of Service

These Terms of Service ("Terms") govern your access to and use of YappJam ("Service"), operated by YappJam ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Account Registration
To use YappJam, you must create an account using a supported authentication provider (Google or GitHub). You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By creating an account, you represent that you meet this requirement.
2. Description of Service
YappJam is a collaborative AI-powered development environment. The Service allows multiple users to create shared sessions ("rooms") where they can collaboratively prompt an AI assistant to write, edit, and manage code. Features include:
- Real-time collaborative AI prompting with Claude
- Code editing and file management within workspaces
- Voice and video communication between collaborators
- GitHub integration for version control
- Figma integration for design context
- Live development server preview
3. Subscriptions and Billing
3.1 Plans and Pricing
Access to YappJam requires a paid subscription. We offer multiple plans with varying feature sets, token allowances, and collaboration limits. Current plan details and pricing are available on our pricing page.
3.2 Billing Cycle
Subscriptions are billed monthly. Your billing cycle begins on the date you subscribe and renews automatically each month. Token allowances reset at the beginning of each billing cycle.
3.3 Cancellation
You may cancel your subscription at any time through your account settings or the Stripe billing portal. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds are provided for partial billing periods.
4. Your Content
4.1 Ownership
You retain full ownership of all code, text, designs, and other materials you create or upload through the Service ("Your Content"). We do not claim any intellectual property rights over Your Content.
4.2 License to Us
By using the Service, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the Service to you. This includes transmitting Your Content to AI model providers (Anthropic) for generating responses, storing it temporarily in workspaces, and synchronizing it between collaborators in your rooms.
4.3 AI-Generated Content
Code and other outputs generated by the AI assistant within your sessions are provided to you for your use. We do not claim ownership of AI-generated outputs produced in your sessions. You are responsible for reviewing and validating all AI-generated code before deploying it to production.
5. Acceptable Use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree not to use the Service in any manner that violates applicable laws or the Acceptable Use Policy.
6. Third-Party Services
The Service integrates with third-party services including but not limited to:
- Anthropic (Claude) — AI model provider. Your prompts and code context are sent to Anthropic for processing. Use is subject to Anthropic's usage policies.
- GitHub — Source code hosting. Repository access is governed by your GitHub permissions.
- Figma — Design tool integration. Design data is fetched using your Figma credentials.
- Stripe — Payment processing. Payment data is handled by Stripe under their terms.
- Deepgram — Speech-to-text processing for dictation features.
We are not responsible for the availability, accuracy, or policies of third-party services. Your use of third-party services through YappJam is subject to those services' respective terms and conditions.
7. Workspace and Data Handling
Code workspaces are created as temporary environments on our servers. Workspaces associated with inactive rooms may be automatically deleted after a period of inactivity. You are responsible for pushing your work to GitHub or otherwise saving it before ending a session.
We do not guarantee long-term storage of workspace contents. The Service is designed as a collaborative development environment, not a code hosting or storage platform.
8. Availability and Uptime
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service downtime.
9. Limitation of Liability
To the maximum extent permitted by law, YappJam and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that AI-generated code will be error-free, secure, or suitable for any particular purpose. You are solely responsible for testing, reviewing, and validating all code produced through the Service before use in production environments.
11. Indemnification
You agree to indemnify and hold harmless YappJam from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, upon notice to you. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including ownership, liability limitations, and indemnification) will survive.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
